Shipping to Other States: A Reminder to all IACP Members

Does your pharmacy send compounded preparations to residents of other states?  Does your pharmacy fill and dispense manufactured prescription drug products to patients who live out-of-state?  Do you process and ship "office-use" prescriptions or sell prescription medications to prescribers in other states?  

What licensing is necessary to ship compounds into other states?

Pharmacies which dispense and ship prescription medications to patients residing outside their state are required to obtain out-of-state pharmacy permits in all states except for Pennsylvania and Massachusetts. Georgia changed its law in April 2013 to require non-resident pharmacy permits. Massachusetts currently has legislation pending to do so as well; however, that law has not yet been enacted.
The legislation establishing out-of-state pharmacies to be licensed and subject to disciplinary action by a state Board was originally introduced in the early 1990’s with the proliferation of mail-order pharmacy services. As compounding pharmacists have expanded their geographical services, more and more are finding it necessary to obtain additional permits.

Some states provide exemptions for obtaining an out-of-state permit. For example, a pharmacy that ships a prescription drug to one of their regular patients who is on vacation in another state and needs an emergency refill may not need to register. State permitting requirements vary and can be found by calling the relevant Board or visiting their website for application instructions.

Have you Received a Ther-Rx Cease & Desist Letter?

Have you received a letter from Ther-Rx (KV Pharmaceutical's marketing arm for MakenaTM) regarding hydroxyprogesterone caproate? Click here to view the letter.

IACP Members: Please be advised, this is a blanket "warning letter" which Ther-Rx is using to create confusion. Note that it is really nothing more than an information letter. It does not accuse or suggest you are doing anything specifically at your pharmacy. 

If you actually read the statement from the FDA cited in the letter, there is nothing new or unusual here. A pharmacy that is engaged in large-scale production of a commercially available product would indeed be violating section 503(a) of the Food Drug and Cosmetic Act. Click here to read the entire article.

What to Consider if Compounding for Prison Executions

There are several business issues to consider when approached to compound a medication used for executions that are separate from the ethical and legal ones.

First, make sure your professional liability insurance provides coverage for such an action. Second, consider the potential security implications to your practice, your employees and your families. Given that the death penalty is a controversial and very high-profile issue, having your pharmacy known as the source of the lethal medicine may bring unwanted attention -- from the media, picketing by death penalty opponents, threats, etc.

Identifying Contamination Faster Using New Environmental Monitoring Technologies 

Environmental monitoring is an essential component of any QC microbiology program and is used to determine the microbial and particulate content of air and surfaces and operators. Identifying and addressing contamination in compounding pharmacy production is critical since it can damage product, lead to product recall, slow product’s time to market and compromise consumer safety. A variety of approaches and new technologies for environmental monitoring exist to help identify conditions contributing to excessive microbial and particulate levels, as well as to alert personnel to conditions compromising the area classification.

Thomas C. Kupiec, PhD to Present the Latest on Quality Control and Quality Assurance Procedures for Your Pharmacy
