IACP Takes Lead on Senate Compounding Legislation

After months of intensive work with Congress, the International Academy of Compounding Pharmacists (IACP) is directly involved in proposing revisions and recommendations to the Senate HELP draft legislation on pharmacy compounding oversight.  That draft, released on April 26, 2013, has many potentially harmful provisions which your Academy is fighting to remove.  These include:

  • Restrictions on veterinary compounding.
  • Elimination of office-use compounding.
  • Elimination of anticipatory compounding.
  • An exemption for hospitals and health-systems from any oversight.

Today, May 3, 2013, IACP is submitting recommended revisions of the legislation with explanatory notes to the Senate Committee.  Those documents, once received by Congress, will be shared with all IACP members. 

Next week, on Thursday, May 9, IACP will be the only organization representing the professional and business interest of pharmacy compounders in a formal hearing before the Senate.

IACP is the only voice of compounding specifically invited to testify at a special hearing before the Senate on Thursday, May 9, 2013. Be part of an important briefing on our response to the Senate HELP Committee’s draft legislation on expanded oversight of pharmacy compounding and the issues we will raise in oral testimony before the Senate. IACP Launches Extensive Media Tour

In the months following the fungal meningitis outbreak, which has now left over 50 dead and more than 700 sickened, the International Academy of Compounding Pharmacists (IACP) has proactively educated the media, public, and policymakers on the role of compounding pharmacy in our health care system.

As we work to increase understanding of the compounding profession, its high-quality standards, and code of ethics, the unsettling facts of this tragedy continue to be misunderstood.
Not only was the New England Compounding Center deemed an illegal drug manufacturer by its Board of Pharmacy – shipping hundreds of contaminated injectable medications across state lines – the FDA had the authority to take action against NECC well before it did harm. The FDA has authority to inspect all pharmacies, including compounders, as well as the Congressional authority to oversee and regulate prescription drug manufacturers.
To clarify this and many other misconceptions, IACP launched a national media tour, which to date has included interviews with the Wall Street Journal, Associated Press, ABC News, CBS News, Boston Globe, New England Cable News, USA Today, Bloomberg News and The MetroWest Daily News. Our primary goal is to reinforce the industry’s reputation and role as a vital service that’s depended upon by millions of patients. In order to continue to meet the needs of patients and protect the public, we have recommended state regulation changes that will make compounded medications safer without restricting pharmacies’ ability to provide vital, and in some cases life-sustaining, medication to patients. If clarifications are needed to existing federal law, we are open to those discussions as well.

George J. Malmberg, Chief Executive Officer of Wedgewood Pharmacy, Passes Away


IACP sends its sincerest condolences to the family, friends and colleagues of George J. Malmberg, RPh, FACA, FACVP, who passed on April 22, 2013. A long-time IACP Member, George served on the IACP Board, and was Vice President from 1995 to 1997. He was an integral part of the formation of IACP's advocacy organization, P2C2.  The 19th Annual Compounders on Capitol Hill (CCH) will be held June 1-4, 2013 at the Crystal Gateway Marriott in Arlington, Va.
